1. General Information

1.1. Contracting Parties

ZEBRES is the commercial name of SARL OKO, a company whose head office is located at 14 rue François Miron 75004 Paris ("ZEBRES", "SARL OKO", "OKO" or "we") which sells decorative objects, works of art and provides interior design services ("Online Shop") at www.zebres.paris. At this address, the customer ("customer" or "you") can purchase products sold by ZEBRES.

1.2. Consumer, Trader

The customer is considered to be a consumer if the goods or services he orders are not primarily intended for the exercise of his commercial activity or his auto-entrepreneurial activity. Conversely, the trader is defined as any private person, legal person or legal partnership with legal capacity who, at the time of the conclusion of the contract, is acting in the exercise of his commercial activity or his activity as an auto-entrepreneur.

1.3. Validity of the General Terms and Conditions of Sale

These general terms and conditions apply to all contracts concluded between ZEBRES and the customer within the framework of a sale of goods concluded on the Online Shop. The customer's general terms and conditions, if they conflict with or vary from the terms and conditions below, do not apply unless we have agreed their validity in writing. The terms and conditions below also remain valid when we perform the delivery and service without reservation, even if the Customer's terms and conditions conflict or vary from the terms and conditions below.

1.4. Modification of the General Terms and Conditions of Sale

ZEBRES reserves the right to change these general conditions at any time, as long as these changes are not unreasonably detrimental to the user. Any changes will be notified by e-mail at least 4 weeks before they come into force. Changes are assumed to be approved by the customer, unless the customer expresses his disagreement by e-mail to miron@zebres.paris within 4 weeks after notification. In the case of a modification of the general terms and conditions, the customer will be informed, in particular, of the possibility of contesting, and of the importance of the delay. If the customer abuses his right of objection, we shall be entitled to delete his customer account with effect from the time the changes in question come into force. The customer will always be notified separately.

1.6. Clarification of Dates and Deadlines

Are considered as working days every day of the week, except Saturdays, Sundays and public holidays in metropolitan France.

2. Account Creation and Use

2.1. Account Creation

To order on the Online Shop, you must create a customer account and communicate your personal data. You will find all the details concerning the use we make of your personal data by referring to our privacy policy.

2.2. Accuracy and Use of User Data

The user is obliged to provide the requested information accurately and completely. In addition, he/she undertakes to respect the confidentiality of the access data and not to give it to third parties. The creation of the account is immediately confirmed after the sending of these data.

The user agrees to promptly update his account and other information, including his e-mail address, credit card numbers and expiration dates, so that we can complete his transactions and contact him if necessary.

2.3. Multiple Account Creation

The user cannot have several accounts simultaneously with ZEBRES. We reserve the right to delete multiple accounts, in application of intellectual property rights, after having warned any customer who violates the rules stipulated in subsections 2.1. to 2.3.

3. Offer and Availability

3.1. Product Images

On the Online Shop, the goods sold by ZEBRES are presented by images. Slight differences between what appears on the image and the actual characteristics of the ordered product are not considered as defects. For example, it may happen that the colour is a little different due to the brightness and lighting.

3.2. Product Description

On the Online Shop, the goods sold by ZEBRES are described by our teams. We pay particular attention to this to enable you to make your purchasing decision with as many elements as possible at your disposal. The items we sell are mostly unique or handcrafted, most often by hand. Likewise, antiques, vintage pieces and other second-hand products necessarily have wear marks related to their age, history and period of creation. We describe as best as we can these imperfections which, in our opinion, make the charm of each of these objects. Despite all the care we take, we unfortunately cannot be exhaustive. We can only give an account of the general condition and list any important lacks or damages.

3.3. Availability

Depending on the availability of the product, we will or will not accept your order. Most of the goods sold by ZEBRES are unique pieces or have been produced in very small quantities. Furthermore, we have several sales channels in addition to our Online Shop (physical shop, trade shows, ephemeral sales, etc.), and we cannot, therefore, guarantee their availability in real time. In the event that all or part of your order is unavailable, we will inform you immediately by e-mail. We encourage any individual or professional customer who wishes to place a large order and ensure the availability of the items they are interested in beforehand to send us an e-mail to miron@zebres.paris.

3.4. Changes in supply and products

We reserve the right, but are not obligated, to limit sales of our products or services to any person in any geographic area or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services we offer. All product descriptions and product prices are subject to change at any time without prior notice, at our sole discretion. We reserve the right to stop offering a product at any time. Any service or product offerings on this site are void where prohibited by law.

4. Conclusion of the Contract

4.1. Contracting Party

On the occasion of a purchase, you conclude a contract with SARL OKO, whose head office is located at 14 rue François Miron 75004 Paris.

4.2. Ordering Online

The online catalogue displayed on the Online Shop is not legally binding. By clicking on "Place Order", the order placed is only binding for the products in your shopping cart. The order confirmation sent after placing the order does not yet constitute a contractual commitment. Its sole purpose is to give an overview of your order, which you can also view via your password-protected user account.

Please ensure that your order details are correct. Once your order has been placed, we are no longer able to amend your invoice, including the VAT charged and the name and address of the invoice.

4.3. Order Acceptance

Within 5 days, you will be informed by e-mail of the acceptance of your order. It is only after this acceptance that payments made by the customer (including bank transfers) become due.

We reserve the right to refuse any order you place with us. We may, at our sole discretion, reduce or cancel quantities purchased per person, per household, per order or by other criteria. These restrictions may include orders placed by or from the same customer account, credit card, and/or orders that use the same billing and/or shipping address.

In the event that we change or cancel an order, we may attempt to notify you by contacting you at the e-mail and/or billing address/phone number provided at the time the order was placed. We reserve the right to limit or prohibit orders that, in our sole discretion, may appear to be from merchants, resellers or distributors for products that we supply only to our particular customers.

5. Right of Withdrawal of ZEBRES in case of non-availability after Conclusion of the Contract

If, for reasons external to ZEBRES, the product is no longer available after conclusion of the contract and acceptance of the order, ZEBRES must inform the customer immediately and may terminate the contract. In such a case of termination of the contract, ZEBRES must reimburse the customer for the sums it has paid to date.

6. Prices

6.1. Pricing Details

For all orders placed on zebres.paris, the price displayed is in euros. The price displayed is the final price, in that it includes value added tax (if applicable) and other costs, with the exception of shipping costs and local taxes and customs duties.

6.2. Vouchers, Accounts Receivable and Promotions

It is impossible to accumulate several discounts on a single purchase in the Online Shop. Vouchers can only be used once, and cannot be combined with each other or with the available credit on a customer account. Unless expressly mentioned, "On Sale" promotions cannot be combined with percentage vouchers.

7. Terms of Payment

7.1. Means of Payment

To date, the payment methods on zebres.paris are as follows: credit card (Visa, MasterCard, American Express) and bank transfer.

7.2. Credit Card Payments

Payment by card is entrusted to the company Stripe. The entry of your credit card number as well as its expiry date and its cryptogram is done on a highly secure page directly at

Stripe. The Site does not store any card numbers. Payment processing by Stripe is certified by Visa and Mastercard as compliant with the PCI/DSS Standard. This certification specifies the application of the strictest security rules in order to protect the Customers' bank card data. The debit to the Customer's bank card will be made in euros when the order is accepted by Stripe.

8. Retention of Title

The delivered product remains the property of ZEBRES or its partners until full payment by the customer.

9. Delivery, Shipping and Costs

9.1. Delivery and Shipping

ZEBRES has surrounded itself with the best service providers and professionals so that the delivery takes place in the best conditions while guaranteeing you very competitive prices.

ZEBRES organizes the shipments for its customers and bears the risks until the delivery, if the customer is a private individual. When the customer is a professional, the transfer of responsibility may take place before final delivery, in which case this would be specified to the buyer at the time of concluding the sale.

9.2. Partial Deliveries

ZEBRES is entitled to make partial deliveries.

9.3. Delivery and Shipping Costs

The delivery price is calculated during the order confirmation process and takes into account the quantity and characteristics of each object that makes up the order as well as the delivery address, in particular. This price includes the preparation, packaging and delivery of the order carried out by the partners that ZEBRES has selected. ZEBRES chooses the service providers (packers, handlers) and carriers (postal services, courier services, delivery people or specialized carriers) that seem to ZEBRES to be the most suitable for each delivery according to the nature of the objects.

Each delivery is handed over against signature at the door of the customer's home, building or warehouse. If you wish to add services to the delivery (unpacking, installation), please contact us at miron@zebres.paris. We will be happy to collect your expectations and submit a personalized quotation.

Any sales tax, import and customs duties and any processing fees on goods sent outside the European Union are not included in the delivery amount and shipping charges will have to be paid before delivery takes place.

All islands, as well as the states of Hawaii and Alaska in the United States, are not included in our standard shipping rates shown online. For orders in these geographic areas, please contact us at miron@zebres.paris before placing your order and you will receive a shipping quote. Please note that this list is not exhaustive and that we may charge additional shipping fees for remote areas.

9.4. Delivery time

The delivery times indicated on our Online Shop are calculated from the confirmation of the purchase (conclusion of the contract), and from the receipt of payment by ZEBRES, if the purchase was paid by bank transfer.

The product delivered may be subject to the schedule of our suppliers or partners if it is a special order or a product stored at one of our stockists.

9.5. Right of Withdrawal in Case of Default in Delivery

In the event of obstacles to timely delivery, ZEBRES will keep the customer informed of the development of the situation. The customer, like ZEBRES, is entitled to withdraw from the contract if the delay in delivery is more than 4 weeks. This does not affect the customer's right of withdrawal (see below). Withdrawal results in the immediate and full refund of the sums paid by the customer.

10. Right of Withdrawal

10.1. Validity

You have the right to withdraw within 14 days. You do not need to give any reasons for your withdrawal.

The withdrawal period is 14 days from the date on which you or a third party appointed by you (who is not the carrier) takes possession of the goods.

In the case of a single order consisting of several goods, this 14-day period begins when you or the third party appointed by you have taken possession of the last product.

If a single item consists of several rooms or objects, this 14-day period begins when you or the third party mandated by you have taken possession of the last room.

You must inform us of your willingness to exercise your right of withdrawal at the following address: SARL OKO (limited liability company), 14 rue François Miron 75004 Paris, miron@zebres.paris, +33143365953. Your declaration, made by e-mail, fax, or postal letter, must explicitly express your wish to cancel the contract. To do so, we provide you with a cancellation model (see below).

In order to comply with the cancellation period, you only need to send the letter before its expiry, i.e. 14 days.

10.2. Consequences

If you withdraw from the contract, we are obliged to refund all payments we have received from you, including postage, immediately (except for any additional costs due to a specific delivery option that is more expensive than standard delivery) and no later than 14 days from the date of receipt of your letter/e-mail/fax. Refunds will be made via the payment method you used to place the order, unless otherwise agreed with you. No charge will be made to you in connection with this refund.

For goods delivered by post, you must return them to us within 14 days of receipt by you of our notification informing you of the cancellation of the contract. You will be responsible for shipping costs.

For goods delivered by other means, we will organise the return. The costs are also your responsibility and are estimated at the sum corresponding to the shipment of equivalent goods.

In the event of a loss in value of a product, which results from unjustified handling on your part, you will have to pay compensation.

12. Warranty and liability

12.1. Disclaimers of Liability

ZEBRES is exempt from any obligation to compensate, except in the following cases :

Damage harmful to health, life and body resulting from negligence on the part of ZEBRES, its legal representative or a vicarious agent;

(ii) Damages resulting from an infringement by ZEBRES, its legal representative or a vicarious agent concerning the essential rights and obligations of the contract, which calls into question the very object of the contract;

(iii) Damages resulting from gross or deliberate negligence on the part of ZEBRES, its legal representative or a vicarious agent;

(iv) Liability for defective products;

(v) Liability due to the guarantee at stake.

In cases (i), (ii) and (iii), the liability of ZEBRES is limited to contractual and foreseeable damages.

The exemption and limitation of liability of ZEBRES also applies to its legal representatives and vicarious agents.

13. Promotional Vouchers

13.1. Offer and Validity of Promotional Vouchers

ZEBRES offers promotional vouchers with a limited period of validity as part of an advertising campaign. These cannot be purchased. Some products may be excluded from the promotion.

13.2. Value of Goods and Credits Remaining after Use of a Voucher

The value of the product must match the amount of the voucher. For legal reasons, we cannot refund the remainder of a voucher.

13.3. Use of Vouchers

The vouchers can only be used before the order is placed. Subsequent use is not possible. The credit of a voucher is not paid in cash and is not subject to interest.

13.4. Transfer of Purchase Vouchers to a Third Party and Accumulation

A voucher cannot be transferred to a third party or combined with another voucher.

13.5. Payment of the Remaining Amount

If the amount of a voucher does not cover the price of the order, the difference can be paid by all available payment methods.

13.6. Voucher Refunds

It is not possible for us to refund a voucher, since it is issued as part of an advertising campaign.

15. Miscellaneous

15.1. Applicable Law

These general conditions are subject to French law, except for cases falling under the United Nations Convention on Contracts for the International Sale of Goods.

These General Terms and Conditions of Sale are subject in all respects to French law.

They have been drawn up in the French language, which shall be considered, in any event, as the sole language.

The parties agree to do their utmost to resolve amicably any dispute that may arise from the interpretation, execution and/or termination of these General Terms and Conditions of Sale.

Failing this, the said dispute shall be subject to the exclusive jurisdiction of the French courts, even in the event of an incidental or warranty claim or multiple defendants.

15.2. Modifications to these General Terms and Conditions

ZEBRES reserves the right to change these general conditions at any time, as long as these changes are not unreasonably to the user. 15.3. Ineffectiveness of Individual Clauses

If it is stipulated that these terms and conditions are ineffective, this does not affect the effectiveness of others.
